Health Club Closings

You joined a health club to get in shape but now your gym is closing its doors. What are your rights as a consumer?

Your Rights Under NC Law

  • Under North Carolina law, when a health club closes it can transfer your membership to another club as long as the new club is within eight miles of the old one and offers basically the same services. For example, if the old health club had a pool or provided childcare, the new one should, too.
  • If your membership is transferred to a new club and you believe that the new club does not offer the same services as your previous club, file a complaint with our office.
  • In many cases, North Carolina law requires health clubs to purchase a bond and file it with the Attorney General’s Office. If you paid for health club membership in advance and the club shuts down without offering to transfer you to a similar club, we may be able to help you get your money back for any services you are still owed.
