(RALEIGH) Attorney General Josh Stein today announced that Dwayne G. Davis has been sentenced to 242 to 333 months in prison and given a mandatory $500,000 fine after being convicted of Level III Trafficking in Heroin, Possession of a Firearm by a Felon, and Possession of a Firearm with an Altered Serial Number. He was sentenced in Vance County Superior Court by Judge Josephine Kerr Davis. The North Carolina Department of Justice’s Special Prosecutions Section prosecuted this case.
Davis was convicted in February, but he fled to Morocco and then flew to Mexico. In May, he was apprehended by the U.S. Marshals Service as he was trying to re-enter the United States on a cruise ship traveling to Miami.
“Going after the traffickers who are leaving death and destruction in their wake is an important part of confronting our state’s opioid crisis,” said Attorney General Josh Stein. “I thank the Henderson Police Department for its investigation of this case and the U.S. Marshals Service for apprehending this individual. My office will continue to hold offenders accountable to keep drugs off our streets.”
The convictions stem from Davis’ assault of two women in September 2013. After Davis fled the scene, law enforcement were called and found drug paraphernalia, firearms, two bags of heroin weighing 49.32 grams, and a cutting agent that is mixed with street heroin. The amount of heroin found would yield more than 2,400 dosage units of heroin and would have had an extremely high street value. There was also additional evidence indicating Davis was in the process of cooking a cutting agent for heroin distribution. Davis later admitted that he intended to package the drugs for sale.
