Proposed Rule Amendments

The Sheriffs’ Commission is proposing modification to its administrative rules which requires a public rulemaking hearing and a period of time to allow public comment. The information below provides guidance for how to comment on these proposals.  Written comments may be sent to Projects Manager Robin P. Public Hearing: July 16, 2026, at 10:00 am at 1700 Tryon Park Dr., Raleigh NC.

Public Comment Period ends on August 31, 2026, with a proposed effective date of November 1, 2026. Note that Rule 12 NCAC 10B .2104 will have an effective date of January 1, 2027. The text can be found in the NC Register Vol. 41, Issue 01.

12 NCAC 10B .0204 Suspension: Revocation: or Denial of Certification – This amendment will add two additional grounds upon which the Commission may revoke, deny, or suspend the certification of a justice officer.

12 NCAC 10B .0205 Period of Suspension, Revocation, or Denial – This amendment provides for the appropriate sanctions for when the justice office is found to have engaged in the activity provided in the corresponding 10B .0204 amendments.

12 NCAC 10B .0304 Medical Examination – This amendment allows a waiver of the medical exam under specified conditions.

12 NCAC 10B .0305 Background Investigation – This amendment modifies the wording “age of majority” to “age of 18 years of age.”

12 NCAC 10B .0408 Verification of Records to the Division – This amendment clarifies when and how criminal record checks are to be conducted.

12 NCAC 10B .2104 Annual Firearms Qualifications* – This amendment provides additional details to the required annual firearms qualifications for authorized deputy sheriffs and detention officers. It is also modified in cooperation and in conjunction with the Criminal Justice Commission’s proposed firearms rule.

Public Comment Period ends on June 15, 2026, with a proposed effective date of August 1, 2026. The text can be found in the NC Register Vol. 40, Issue 20.

12 NCAC 10B .1303 Time Req/Completion/Telecommunicator Certification Course The amendment eliminates unnecessary language.

12 NCAC 10B .1304 Evaluation for Training Waiver The amendment adds the word “certification” for clarity.

12 NCAC 10B .1305 Trainee Attendance The amendment eliminates unnecessary language and adds wording for clarity.

12 NCAC 10B .1306 Completion of Telecommunicator Certification Course The amendment eliminates unnecessary language and adds wording for clarity.

12 NCAC 10B .1308 Satisfaction of Minimum Training Requirements The amendment eliminates unnecessary language.
