Proposed Rule Amendments
The Sheriffs’ Commission is proposing modification to its administrative rules which requires a public rulemaking hearing and a period of time to allow public comment. The information below provides guidance for how to comment on these proposals. Written comments may be sent to Projects Manager Robin P. Public Hearing: November 17, 2026, at 10:00 am at 1700 Tryon Park Dr., Raleigh NC.
Public Comment Period ends on January 4, 2027, with a proposed effective date of March 1, 2027. The text can be found in the NC Register Vol. 41, Issue 09.
12 NCAC 10B .0413 – This rule for adoption contains the contents of the portion of repealed Rule 10B .0406 that explains the requirements for detention officers and telecommunicators who are lateral transfers.
12 NCAC 10B .0414 – This rule for adoption contains the contents of the portion of repealed Rule 10B .0406 that explains the requirements for all justice officers who are reinstated after being suspended under the Commission’s rules.
Note: Rule 10B .0406 will be repealed simultaneously through the Periodic Rule Review process referenced below.
Proposed Rule Amendments pursuant to the Periodic Review Process
The Sheriffs’ Commission is also conducting a review of all its administrative rules, pursuant to the requirement of Chapter 150B of the NC General Statutes, by proposing adoption, modification or repeal of its administrative rules which requires a public rulemaking hearing and a period of time to allow public comment. Written comments may be sent to Projects Manager Robin P. Pendergraft, 1700 Tryon Park Drive, Raleigh NC 27610 or by email: rpendergraft@ncdoj.gov.
Purpose of Rule Changes: Technical changes; to readopt rules in accordance with the periodic review process; to amend professional certificate program requirements; to update probationary certification requirements; to update and clarify agency head responsibilities; and to amend basic and in-service training requirements.
