Attorney General Jeff Jackson Wins Preliminary Injunction Against Unlawful Attempt to End Birthright Citizenship

RALEIGHAttorney General Jeff Jackson today won a preliminary injunction from a federal judge to block the attempt to end birthright citizenship in the United States.

Attorney General Jackson released the following statement:

“This executive order was a straightforward violation of the Constitution and conflicted with longstanding Supreme Court precedent. The 14th Amendment has guaranteed birthright citizenship for over a century, and today’s ruling reinforces that fundamental principle.”

Attorney General Jackson took legal action against this executive order in January. The court enjoined the executive order, finding that Attorney General Jackson and other plaintiffs were “nearly certain to prevail” on their claims under the Fourteenth Amendment of the United States Constitution and the Immigration and Nationality Act.

Attorney General Jackson was joined in filing this lawsuit by the Attorneys General of California, Colorado, Connecticut, Delaware, Hawaii, Maine, Maryland, Massachusetts, Michigan, Minnesota, Nevada, New Mexico, New Jersey, New York, Rhode Island, Vermont, Wisconsin, and the District of Columbia, and by the City and County of San Francisco.
